These Terms of Service govern your use of the Heritage & Co. website and the purchase of products from Heritage & Co. (“we”, “us”, “our”). By accessing our website or placing an order, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website or services.

By placing an order, you confirm that:

You are legally capable of entering into binding contracts

The information you provide is accurate and complete

Heritage & Co. reserves the right to refuse or cancel orders at its discretion.

3. Products & Availability

All products are subject to availability.

Due to the nature of fine jewellery:

Product images are for illustrative purposes
Minor variations in colour, stone characteristics, or finish may occur
We reserve the right to discontinue products at any time

Custom-made and made-to-order pieces are produced specifically for the customer and may require extended lead times.

4. Pricing & Payment

All prices are displayed in South African Rand (ZAR) unless otherwise stated.

Prices:

Include VAT where applicable
Exclude shipping and duties unless expressly stated

We reserve the right to:

Correct pricing errors
Change prices without prior notice
Cancel orders affected by obvious pricing inaccuracies

Payment must be received in full before an order is processed.

5. Order Acceptance & Confirmation

An order is considered accepted only once:

Payment has been successfully processed, and
You receive an order confirmation email from Heritage & Co.

Order confirmations do not guarantee availability until acceptance is complete.

6. Custom, Personalised & Made-to-Order Items

Certain items are produced on a custom or made-to-order basis, including engraved or personalised jewellery.

Once production has begun:

Orders cannot be cancelled
Items cannot be returned or exchanged, except where required by law

7. Delivery

Delivery timelines are estimates and not guaranteed.

Heritage & Co. is not responsible for delays caused by:

Courier services
Customs or regulatory authorities
Force majeure events

Risk of loss passes to the customer upon delivery.

8. Returns & Refunds

Returns and refunds are governed by our Return & Refund Policy, which forms part of these Terms.

Please review this policy carefully before placing an order.

9. Intellectual Property

All content on this website, including but not limited to:

Logos
Designs
Product images
Text, graphics, and branding

is the exclusive property of Heritage & Co. and may not be used, reproduced, or distributed without prior written consent.

10. Website Use

You agree not to:

Misuse the website
Attempt unauthorised access
Interfere with site security or functionality
Use the website for unlawful purposes

We reserve the right to restrict or terminate access for violations.

11. Limitation of Liability

To the fullest extent permitted by law:

Heritage & Co. shall not be liable for indirect, incidental, or consequential damages
Liability shall not exceed the value of the product purchased

Nothing in these Terms limits liability where prohibited by law.

12. Warranties & Repairs

Jewellery is subject to normal wear and tear.

Manufacturing defects may be assessed and addressed through repair or replacement at our discretion. Damage caused by misuse, accidents, or unauthorised repairs is excluded.
